New Jersey filed a lawsuit on Tuesday against GEO Group, the private company that operates the Delaney Hall immigration detention center in Newark. The state is demanding that the company grant the New Jersey Department of Health unrestricted access to the facility.
The legal action stems from what state officials describe as repeated denials of entry for health inspectors. According to the lawsuit, GEO Group has blocked state health workers from conducting routine inspections and investigations inside the detention center. The state argues that it has a legal right to monitor conditions at the facility, which holds immigrants awaiting deportation proceedings.
New Jersey Attorney General Matthew Platkin stated that the company's refusal to comply with state health laws is unacceptable. He emphasized that the state has a responsibility to ensure all facilities, including federal detention centers, meet basic health and safety standards. The lawsuit seeks a court order requiring GEO Group to allow immediate and full access for health department personnel.
GEO Group has not yet issued a public response to the lawsuit. The company has previously argued that the facility is under federal jurisdiction and that state health inspections are not required. However, state officials maintain that New Jersey law applies to all detention centers operating within its borders.
The case highlights ongoing tensions between state authorities and private prison operators over oversight and accountability.
